七、商业秘密保护

1、乙方应当保守甲方的商业秘密，未经甲方的书面同意不得向第三方(包括新闻界人士)公开和披露任何商业秘密信息或以其他方式使用商业秘密信息。

2、本条规定的保密义务的效力至本条规定的全部保密内容成为社会公众所知悉的信息后终止。

八、劳动合同的变更、解除、终止

1、经甲乙双方协商一致，本协议可以解除。

2、乙方有下列情形之一，甲方可以解除本协议：

(一)在试用期间，被证明不符合录用条件的;

(二)以欺诈手段订立本协议的;

(三)严重违反劳动纪律或对甲方利益造成重大损害的;

(四)严重失职、营私舞弊，对甲方利益造成损失的;

(五)泄露甲方商业秘密，给甲方造成损失的;

(六)被依法追究刑事责任的;

(七)不能胜任协议约定的工作，经过培训或调整工作岗位仍不能胜任工作的;

(八)协议订立时依据的客观情况发生重大变化，致使协议无法履行，经当事人协商不能就变更协议达成新的协议的。

3、有下列情形之一，乙方可以通知甲方解除协议：

(一)甲方以侵害乙方合法人身权利手段强迫劳动的.;

(二)甲方不能按照本协议规定支付劳动报酬或者提供劳动条件的;

(三)甲方违反国家有关规定，劳动安全卫生条件恶劣，严重危害乙方身体健康的;

(四)法律、法规规定的其他情形。

4、乙方解除劳动合同，应当提前三十日以书面形式通知甲方。

九、违约责任

1、如果甲方违反本合同或法律法规，给乙方造成损失的，甲方应按照《中华人民共和国劳动法》等法律规定赔偿乙方。

十、劳动争议处理
