根据《中华人民共和国合同法》、《中华人民共和国____市房地产管理法》及其他有关法律、法规之规定,甲、乙双方在平等、自愿、协商一致的基础上,乙方向甲方购买房产并签订本合同,以资共同信守执行。
第一条:房屋基本情况 甲方房屋(以下简称该房屋)位于____区,该房屋的所有人为,建筑面积为平方米(详见土地房屋权证第号)。
第二条:上述房屋的交易价格 经甲、乙双方协商一致,该房屋总售价为30元,总金额大写:叁拾万零贰仟元整,小写:30元。本合同签订之日,乙方向甲方支付人民币元整,作为购房定金。
第三条:付款时间与方式 甲、乙双方同意以一次性付款方式付款,并约定在房地产交易中心缴交税费当日支付首付款(含定金)人民币元整给甲方,剩余房款人民币元整于产权交割完毕当日付给甲方。
第四条:交付期限及违约责任
1、甲方应于收到乙方全额房款之日将交易的房产全部交付给乙方使用,并应在交房当日将物业费,水电费,取暖费,网费,燃气费等结清(出示相关收据)。
2、乙方逾期未付款的违约责任:乙方须在规定日期内付清房款,逾期未付清房款,甲方有权终止合同,由此造成的损失,甲方不予承担,乙方所交定金,抵作甲方损失。
3、甲方逾期未交房的违约责任:甲方须协助乙方办理相关手续并在交期限内交房给乙方,逾期未交房或乙方发现建筑不合格,甲方须在____日内支付乙方所付定金的双倍作为赔偿,同时乙方有权选择继续购房或终止合同,其中如乙方选择终止合同,甲方须在____日内将乙方所付定金的双倍及已付款一次性退还给乙方。
第五条:税费承担 经双方协商,交易税费由方承担,代办产权手续费由方承担。
第六条:甲方必须保证上述房屋权属清楚,没有产权纠纷或债务纠纷,若有纠纷情况,甲方均在交易前办妥,交易后如有上述未清事项,由甲方承担全部交易中心缴交税费当日支付首付款(含定金)人民币元整给甲方,剩余房款人民币元整于产权交割完毕当日付给甲方。
