见证方:苏州我爱我家房屋租赁置换有限公司(以下简称丙方)

甲乙双方经友好协商,就甲方向乙方转让甲方私人房产一事达成以下条款:

第一条甲方对产权的声明

甲方根据国家规定,已依法取得苏州市_________区(县)的房屋所有权证书,所有权证书_____字第____________号。甲方为该房屋的现状负全责。该房屋的结构为_____________________,建筑面积为_________平方米。

第二条甲方对买卖权的声明

甲方保证该房屋是符合国家及苏州市房屋上市的有关规定及政策法规,甲方有权将该房屋上市交易。由于违反国家及苏州市相关政策法规而引起的法律及经济责任由甲方来承担。

第三条乙方对购买权的声明

乙方愿意在本合同第一条款及第二条款成立的前提下,就向甲方购买上述房屋的完全产权之事签订本协议,并认可仅在此种情况下签订才具有法律效力。

第四条房屋售价

第五条付款方式

2、乙方如未按本协议第五条款规定的时间付款,甲方对乙方的逾期应付款有权追究违约利息。每逾期一天,乙方应支付甲方所应付房款的0、4‰作为滞纳金,逾期超过15天,即视乙方违约,定金不予返还。

3、甲方应在获得全部房款后3个工作日内将房屋搬空,每逾期一天,甲方应按乙方已付房款的0。4‰向乙方付滞纳金,逾期超过15天,即视甲方违约,乙方可要求法院强制执行。

第七条房屋交付甲乙双方就房屋交付达成以下细目:

1)没有房屋欠帐,如电话费、电费、物业管理费、取暖费等;

2)没有固定不可移动装修物品的破坏;

3)房屋本身没有影响房屋使用或美观的破坏;

4)其它:。

第八条关于产权办理的约定本协议签订后,甲乙双方应向房屋所在区(县)房地产交易所申请办理房屋买卖立契过户手续,并按有关规定申领房屋所有权证。办理上述手续时产生的税费及相关费用,由甲乙双方依照有关规定缴纳。办理过程中由丙方先行垫付,在物业交验时提供相应票据。

第九条有关争议本协议未尽事宜,双方可签订补充协议。本协议的附件和双方签订的补充协议为本协议不可分割的组成部分,具有同行法律效力。当本合同在履行中发生争议时,双方协商解决。协商不能解决的,双方均有权向该房屋所在地的人民法院提起诉讼。

第十条生效说明本协议一式四份,甲乙双方各执一份,房屋所在区(县)交易所留存一份,见证方一份。均具有同等法律效力。自双方签字盖章之日起生效。

二、 出资金额、出资比例

五、 物业考察、购买甲乙双方共同对拟购房产进行实际考察、了解。

六、 房地产权证署名、办理、保管

所购物业的所有权凭证要依法载明共有比例情况,即甲方享有60 %、 乙方享有40 %的房屋产权,房地产权证由双方依法办理并由双方妥善保管。

八、 物业管理、出租及收益分配比例由乙方负责所购房产的管护、维护、出租、收取房屋租金等物业管理事务。但出租价格应征得甲方的书面同意,《房屋出租合同》应在正式签署前取得甲 方或甲方委托律师得书面同意。乙方收取承租人的房屋租金后应及时归还银行按揭贷款本息,余额视为房产收益由甲乙双方按照投资比例分配,每一个月结算一次。

九、 购置物业税费承担

产权登记所支出的公正费、保险费、房产交易税费、产权登记税费、律师费、维修基金、物业管理费、取暖费、装饰装修费、水电煤有线电视开通或入户费、中介费(委托中介出租物业)、房屋租金税费等相关费用由甲方承担60 %,乙方承担 40%,并以现金支付。

十、 物权行使

甲乙双方共同行使所购房产的占有、出租、使用、收益、处分等权利,如有一方依法书面授权,另一方也可以代为行使,但房产买卖、抵押、担保必须有双方书面同意。

十一、 物业出卖及优先购买权行使

如甲乙双方共同决定出售所购房产,应依法进行并办理相关手续,盈利或亏损均由甲乙双方按照投资比例享有或承担。在同等条件(市场价或评估价)下,甲乙双方任何一方均有优先购买权;若通知后30日内不予书面答复则视为同意出售房产;如果不同意出售房产又不愿意购买或30日内不以实际行动履行购买承诺的,视为同意出售房产,并应给预积极配合。

十二、如甲乙双方结婚,则该房产变为夫妻共有财产,甲乙双方平等的享有权利和承担义务,平等承担债务,即各占50%.如甲乙双方分手,双方可变卖共有物,所得价金由共有人按份额比例分配。或者进行作价补偿,由双方中的某个共有人取得共有物,并由该共有人向其他共有人补偿其应有部分的价值。

十三、 甲乙双方所购房产的实际产权由甲乙双方按本协议约定共有,所有权由双方共同行使。

十四、 适用法律

本协议适用中华人民共和国法律。

十五、 本协议变更或解除

1、甲乙双方协商一致,可以变更或解除本协议;

2、符合本协议相关条款约定的,可以变更或解除本协议;

3、未经甲乙双方协商一致,本协议不得变更或解除;

十六、 争议解决办法

凡涉及本协议的生效、履行、解释等而产生的争议,先由甲乙双方协商解决,如十五日内协商无果,双方均可向有管辖权的人民法院提起诉讼。

十七、 违约责任:

甲乙双方均应严格信守本协议,不得违约,如有违约,违约方应向守约方赔偿因违约方违约而遭受的一切经济损失。

十八、 本协议未尽事宜,由甲乙双方另行协商,并签署书面文件。

十九、 本协议正本一式六份,甲方贰份,乙方贰份, 律师事务所保存贰份,各份具有同等法律效力。
