5.1若甲方成功出售该房地产,则乙方将向甲方收取上述房地产实际成交总价款的1%作为服务费。

5.2甲方应于乙方介绍的买方签约或类似文件同时将佣金支付给乙方。

5.3甲方如未能按时将佣金支付给乙方,每逾期一日加收佣金总额的万分之五作为滞纳金。

5.4甲方与乙方介绍的买方达成交易后,如果甲方与买方在履行房地产买卖合同时有违约行为的,则按其签订的房地产买卖合同追究违约责任。乙方收取的服务费不予退还。

六、协议的履行

6.1乙方应随时依甲方之查询,向甲方报告业务处理情况。

6.2乙方应积极、努力为甲方提供求购方的信息,尽快完成甲方委托事项。

6.3甲方保证本协议第二条所述情况属实,如因资料不符给乙方或买方造成损失,有甲方负责赔偿。

6.4甲方同意在收到买方所交的定金后,交由乙方代为保管,待甲方与买方正式签署房地产买卖合同时,再由乙方转交给甲方。

6.5如果甲方不同意将收到的定金由乙方代为保管,需在收取定金的同时将其房地产权证书交由乙方保管。

6.6协议履行期间,甲方要求变更协议条款的,应及时书面通知乙方,征得乙方同意后在约定的时限内,变更约定条款或签订补充条款,并注明变更事项。甲乙双方因履行协议而签署的补充协议及其他文件,均为本协议的组成部分,与本协议具有同等效力。

6.7如果甲方违反本协议而委托其他任何第三方,则视为乙方已经完成全部义务,甲方都应按照本协议5.1款规定向乙方支付服务费用。
